We are a law firm offering services in this area, and therefore it is necessary to access certain information that may be considered personal or private in order to provide our services optimally, without requiring any additional information beyond what is necessary for processing the procedures entrusted to us.

In order to comply with section II of article 15 of the current Federal Law on the Protection of Personal Data Held by Private Parties, we inform you that the personal data that may be collected and will be processed in accordance with the guidelines of the aforementioned Law are the following:

In case you require advice:

  • Identification data (name, usual address).
  • Contact information (telephone, email address).

  • Sensitive documents (documents containing intimate information, but required for better advice, previous files, clinical examinations in the case of insurance advice).

In the event that you request our legal services:

  • Signature and official identification.
  • Virtual identification data (e.firma / e.signature).

Personal data may be accessed through third parties only when it is essential for preparing a legal strategy or defense. This data may include bank statements, medical reports, tax information, asset information, and other matters related to the appropriate legal strategy.

The data specified in that section will be requested in order to provide you with personalized, appropriate advice related to the problem raised.

Once the consultation has been provided, your documents will be returned and no record will be kept of what was discussed during the consultation.

The above will not apply if you agree that Nova Lex will be your legal representative, because in that case, the information and documentation provided will be kept under the custody of our staff in order to allow for your defense or representation.

In the event that you request our legal services:

All documents and information deemed necessary and sufficient for the planning of the legal strategy to be followed will be placed under our custody, accepting in that act that it will be given the treatment that is collected for that purpose.

Please be advised that some of the information and documents submitted will need to be made known to the authority before which the administrative or jurisdictional procedure is being or will be processed.

This in no way implies a violation of your privacy. In order to pursue legal action, it is necessary to inform the appropriate authorities of the facts surrounding your situation. Therefore, please be advised that, to ensure the fullest respect and protection of your personal data, we will make all necessary representations to the relevant administrative or judicial authorities to prevent the publication of this information, or, if necessary, to ensure its proper handling.

You are also informed that, should you not wish to disclose this information to the competent authority, there is a risk that the planned legal strategy will not be effective, excluding us from any liability.

Secondary Purposes:

Nova Lex informs you that there are no secondary purposes for the processing of your information.

Means to exercise your right to Access, Rectification, Cancellation and Opposition of your personal data

You or your legal representative (without being able to take simple appointments or that do not meet the legal requirements contemplated in the Civil legislation to be considered as such), may exercise any of the Rights of Access, Rectification, Cancellation or Opposition (hereinafter “ARCO Rights”); as well as the revocation of your consent without retroactive effect, regarding the processing of your personal data by filling out the request for the exercise of ARCO rights through the forms available on the website www.juridiconovalex.com.mx (in the section “Privacy Notices”), which you must send duly completed to the email address derechosarco@juridiconovalex.com.mx, pso that you can exercise your right and where you will be attended to in a timely manner, from Monday to Friday from 9:00 a.m. to 6:00 p.m.

It is necessary to reliably prove your identity as well as that of your legal representative and the latter's representation, for which you must correctly fill out the forms provided on our website and attach a copy or copies of the official identification(s) and the appropriate document that proves representation.

You will be notified of the decision made, within a maximum period of 20 business days from the date the request was received, so that, if applicable, you can make it effective within 15 business days following the communication of the response.

In the case of the Right of Access, by simply exercising it through the corresponding form, you will have the right to access your personal data held by the data controller, as well as to know the information related to the conditions and generalities of its processing that are communicated through this privacy notice; if applicable, Nova Lex may do the following:

1. The contact method provided will be notified so that the holder or their representative can consult them personally at the address previously indicated, after identification and proof of this will be left.

The deadline for accessing this information will be 15 business days. If this period elapses and the requested personal data is not accessed, a new request must be submitted, which will be subject to the aforementioned deadlines.

2. Simple copies may be issued and delivered in hard copy to the address indicated at the beginning of this privacy notice, or alternatively, via the email address designated for this purpose. There will be a period of 10 business days for receiving the physical copies; if they are not received within this period, they must be requested again.

Furthermore, you are informed that, in the event that an email address is provided to receive the digital format of the requested copies, the applicant will be solely responsible for the use given to said information since he is the one who provided the email address.

In case your personal data turns out to be inaccurate, incomplete or not up to date, you may request its Rectification;

You may also request the cancellation of your personal data, after blocking it for its subsequent deletion, so that it is no longer in the possession of NOVA LEX, which, in any case, would be accompanied by the rescission or termination of the service provision contract that may have been entered into, or would also be a consequence of any of these legal acts.

Finally, you may request to object to the processing of your data or demand that it cease when there is a legitimate reason and your specific situation so requires, bearing in mind that this action could hinder any defense or strategy that may be underway.

CHANGES TO THE PRIVACY NOTICE

NOVA LEX reserves the right, at its sole discretion and based on its internal needs, to change, modify, add to, delete, or remove portions of this Notice, in whole or in part, as required to comply with applicable regulations. In any case, notice will be given through any of NOVA LEX's social media channels, via email, or through printed notices posted in our office, as well as on the website www.juridiconovalex.com.mx in the “Privacy Policies” section.
